Privacy Policy

1. Introduction

We understand your concern on how information about you is used and shared, whether you are a Publisher or Influencer, an Advertiser or a User.

This Privacy Policy explains how we work with collect, use and protect information in relation to our services, web site, and any software provided on or in connection with Primetag services (Primetag, SA ("Primetag" or "we") (a company registered in Portugal with number 513251405 and its registered office at IEUA, Campus Universitário de Santiago, Edifício 1, Universidade de Aveiro, 3810-193 Aveiro, Portugal). Explains what personal data and other information is collected by Primetag as part of its activities as we want to make sure you have full transparency over how your data is used.

This Privacy Policy applies to your use of our website and its Tools or any related services which you can find out more in our Terms of Service at https://primetag.com/subscription-terms. We reserve the right to change this policy at any time without notice, so please check it regularly.

Our Policy applies to all visitors, users, and others who access the Service ("Users").

To make it easier for you to review this Privacy Policy which apply to you, we have divided up the document into the following sections:

In this Privacy Policy the following expressions have the following meanings:

“Advertiser” an entity purchasing advertising or marketing services from Primetag directly or through an agent.

“Advertiser Hub” a Primetag’s proprietary, login-protected web portal that may be accessed by Advertisers at www.primetag.com/login to access and configure Tools, view performance and earned revenues reports, and search for participating Publishers and Influencers.

“Agreement” the agreement between Primetag and the Publisher or Influencer which is created on acceptance by Primetag of the Publisher’s application.

“Audience” a group of Users that follow and read Publishers and Influencers posts.

“Retailer” a supplier of goods and/or services which is included in the list of Advertisers on the Publisher Hub.

“Publisher or Influencer” a person or entity who is entitled to access and use the Service under the terms of an Agreement.

“Publisher Hub” a Primetag’s proprietary, login-protected web portal that may be accessed by Publishers at www.primetag.com to access and configure Tools, view performance and earned revenues reports, and search for participating Advertisers.

“Order” following a referral of a User from the Publisher’s website to an Advertiser's website, a supply of goods and/or services by such Advertiser to such User during the cookie life-time (as prescribed by such Advertiser).

“Service” means access to and use of the Publisher Hub and the Tools.

“Tools” means (i) Primetag Javascript/iFrame and (ii) Plug-ins, either of which Publishers and Influencers can use to insert advertisers Product tags with the purpose of earning Revenue and obtaining insights via the Publisher Hub.

“User” a user of the Publishers and Influencers website that is referred to an Advertiser via the Service and/or interacts with the Advertiser by purchasing goods and/or services.

2. General

2.1. Keeping Data secure

Primetag stores your information on secure, firewall-protected servers that are located in secure facilities. These technology and security features, as well as strict internal guidelines, are designed to safeguard the privacy of your personal information from unauthorized access or improper use. We will continue to enhance security as new technology becomes available.
Access to your personal information is only granted to Primetag staff who require such access, more specifically the technical and campaign management departments. Backups are run to reduce the risk of loss of information. We are deeply committed to protect any information you provide in our platform and constant development towards data security is our priority, thus mitigating the threat from unauthorized persons, hardware or any other party that may act with bad intent will be our focus.

2.2. Use of Cookies and Pixel Tags

We use a technology called Cookies. A Cookie is a small data file that is stored on your computer or mobile web browser that allows us tracking and record-keeping purposes. The Cookies that we use tell us your search preferences, various user preferences you have set and which pages you have visited. This way, it helps us provide you additional functionality and help us analyze website usage more accurately.
Unless you have adjusted your browser setting so that it will refuse Cookies, we will drop Cookies onto your Computer when you visit our website.
Additionally, when using Primetag you might be exposed to Cookies provided by third parties, such as Facebook (https://www.facebook.com/policies/cookies), Google (https://policies.google.com/privacy), YouTube (https://www.youtube.com/static?template=terms), Linkedin (https://www.linkedin.com/legal/cookie-policy), Instagram (https://help.instagram.com/519522125107875) and other third party service providers with whom Primetag can be used with. Primetag cannot be responsible for how these third party Cookies are used, and you should consult the Privacy Policies of these third parties for more information about how they use cookies.

We may also use a technology known as Pixel Tag. A Pixel Tag is a small, invisible graphic image that may be used on the Advertiser's site interface to collect certain information and monitor user activity such as: to count visits, to understand usage effectiveness and to track conversions. Pixel Tag provides anonymized, aggregated auditing, research and reporting for us, and for Advertisers.

2.3. Disclosure of the information to third parties

This Privacy Policy covers our treatment of “personally identifiable” information (meaning it can be used to specifically identify you as a unique person) or “non-personally identifiable” information (meaning it cannot be used to specifically identify you) that we may collect in your use of our Services. Just to make it clear, we are not in the business of selling personally identifiable information since we consider this information to be a vital part of our relationship with you.

If you provide personally identifiable data for a certain reason, we may use such information in connection with the reason for which it was provided. For instance, we will use the personally identifiable information provided by you in order to make payment of eligible Revenues.
However, certain circumstances in which we may share personally identifiable information with certain third parties without notice to you including those set forth below:

2.3.1. Agents, Consultants and Related third Parties

We hire other companies to perform certain business-related functions, such as: mailing information, hosting services and processing payments. When we employ another company to perform a function of this nature, we provide them with the information that they need to perform their specific function. We require such third parties to maintain the confidentiality of such information and use such information only as necessary to provide us with the designated services. We only supply the very minimum needed information.

2.3.2. Legal Requirements

We may disclose personally identifiable information if required to do so by law or in the good faith belief that such action is necessary to: comply with a legal obligation and/or protect and defend our rights or property, act in urgent circumstances to protect the personal safety of users, or protect against legal liability.

2.3.3. Business Transfers

As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, personally identifiable information may be part of the transferred assets.

2.3.4. Informal Notices and Bulletins

Periodically, we may choose to send marketing materials, or other information to you, and will use personally identifiable information to send such communications.

You can always choose not to provide personal information to us. However, doing so may prevent you from obtaining certain information or using certain areas of the website and the Service, including the access to the Publisher Hub.
We may use personally non-identifiable information and pool it with other information to track the use of our tools and services in order to improve them. Such information is collected passively using various technologies. Examples include IP addresses, browser types, domain names, and other anonymous statistical data involving you use of the website and the Services. No personally identifiable information is available or used in this process.

2.4. Right to rectification

The data subject shall have the right to obtain from Primetag without undue delay the rectification of inaccurate personal data concerning him or her. Taking into account the purposes of the processing, the data subject shall have the right to have incomplete personal data completed, including by means of providing a supplementary statement.

2.5. Right to erasure

The data subject shall have the right to obtain from the controller the erasure of personal data concerning him or her without undue delay and Primetag shall have the obligation to erase personal data without undue delay where one of the following grounds applies:

  1. the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;

  2. the data subject withdraws consent given;

  3. the data subject objects to the processing pursuant and there are no overriding legitimate grounds for the processing;

  4. the personal data have been unlawfully processed;

  5. the personal data have to be erased for compliance with a legal obligation in Union or Member State law to which the controller is subject.

2.6. Notification obligation

Primetag shall communicate any rectification or erasure of personal data or restriction of processing carried to each recipient to whom the personal data have been disclosed, unless this proves impossible or involves disproportionate effort. Primetag shall inform the data subject about those recipients if the data subject requests it.

2.7. Right to data portability

See that, as holder of personal data, shall have the right to receive the personal data concerning him or her, which he or she has provided to Primetag, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided, where:

  1. the processing is based on consent according; and

  2. the processing is carried out by automated means.

In exercising his or her right to data portability pursuant, the data subject shall have the right to have the personal data transmitted directly from one controller to another, where technically feasible.

2.8. Notification of a personal data breach to the supervisory authority

Know that, in the case of a personal data breach, Primetag shall without undue delay and, where feasible, not later than 72 hours after having become aware of it, notify the personal data breach to the supervisory authority competent, unless the personal data breach is unlikely to result in a risk to the rights and freedoms of natural persons. This notification is made by the Primetag in accordance with the law in force.

2.9. Changes to Our Privacy Policy

Primetag may modify or update this Privacy Policy from time to time, so please review it periodically. We may provide you additional forms of notice of modifications or updates as appropriate under the circumstances. Your continued use of Primetag or the Service after any modification to this Privacy Policy will constitute your acceptance of such modification.

2.10. Other Web Sites

We are not responsible for the practices employed by any websites or services linked to or from our Service, including the information or content contained within them. When you use, namely, a link to go from our Service to another website or service, our Privacy Policy does not apply to those third-party websites or services and remember that your browsing and interaction on any third-party website or service, including those that have a link on our website, are subject to that third party's own rules and policies. In addition, you agree that we are not responsible and do not have control over any third-parties that you authorize to access your User Content.
So, if you are using a third-party website or service and you allow them to access your User Content you do so at your own risk. Please note that, to revoke the API Client's access, you can access via the Google security settings page at https://security.google.com/settings/security/permissions.

2.11. Children's Privacy

Primetag does not knowingly collect or solicit any information from anyone under the age of 16 or knowingly allow such persons to register for the Service. The Service and its content are not directed at children under the age of 16. In the event that we learn that we have collected personal information from a child under age 16 without parental consent, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 16, please contact us (see 2.12.).

2.12. Use of YouTube API Services

Our platform utilizes YouTube API Services to provide certain features and functionalities to our users. By using our services and connecting your YouTube account, you acknowledge that we collect and process data from your YouTube account through the YouTube API Services.

3. Publishers and Influencers

This section describes what information is collected by Primetag from Publishers and Influencers and how that information is used by Primetag.

3.1. Information we collect

3.1.1. Registration

When a Publisher or Influencer signs up to use the Service and Tools, we may collect and store various pieces of Personally Identifiable Information: name, date of birth, gender, email address, telephone number, Address, Bank/Paypal details, tax identification, website url and description, links to social media profiles, social media posts, brand name and correspondent logo, profile picture and invoices of any commercial actions with Primetag.
This Personally Identifiable Information is stored and processed in accordance with this Privacy Policy.
To join our club they must, in the pre-registration, give their consent before continuing. Only in this way Primetag is sure that the processing of the data is lawful. For this reason it is only possible to proceed if the data subject gives his/her prior consent.
Still at the pre-registration we require the user to select his social networks and pages in order to Primetag to verify the ownership of those accounts in a manual verification.

3.1.2. Usage

Whenever you interact with our Services, we may collect personally non-identifiable information using various technologies that cannot presently be used to specifically identify you, such as: IP address, language setting, operating system type, the page you requested, and time stamp. We also collect information about your search and click activity when using the Service.

3.1.3. Third Party

If you provide or connect your third-party account credentials to an account with a Service, some content and/or information in those accounts may be transmitted into your account within Primetag. For example, when you connect with Facebook for sign-in, we receive and collect your name, email address, profile photo and list of pages.
Primetag only accesses this information if you give consent at the due stage.
Note that, user data obtained through social networks will not be transferred to a data broker.

3.2. Use of Information collected

We use this information to perform our obligations and provide and develop the Service. Some of the Tools our Service offers might rely on the use of information we have collected from you in order to ensure that the Tools in question are customized and targeted for your specific use. The use of information collected have different purposes: to assess the suitability of Publishers and Influencers for the Service and allow them to set up their account and profile, to contact and help with registration, use, optimization of the Service and related matters, to detect, investigate and/or prevent fraudulent and unauthorized or illegal activity, to pay their revenue earned through the use of the Service, to provide information about performance and billing, to improve the Service we provide based on how Publishers and Influencers use our Service and the Tools provided, and to find the best match between Publishers and Influencers interests and Advertisers.

3.3. Updating information

Publishers and Influencers can edit any of their personal information when using the Service by accessing the setting's page. It is their responsibility: to protect against unauthorized access to their details, to log-off from the Publisher Hub when not using it, and to keep its password secret.

3.4. How the Information is collected

Once a Publisher or Influencer use the Service and adds Primetag's iFrame to its CMS or backoffice or installs Primetag Tools in its template, a JavaScript file will be downloaded and do the following: collect and store information about product Tags that Users click on, so we can monetize the ones from participating Advertisers, and report on other outbound clicks, drop a Cookie when a User visits a web page or clicks on a product Tag, so we can record anonymous information about the pages, links and Advertisers visited by Users across our Publisher and Influencer network.

3.5. Information collected from your Audience

Primetag will not knowingly collect or store any Personally Identifiable Information pertaining to Users visiting a Publisher or Influencer using the Service.
Primetag does use cookies and Pixel Tags to collect non-Personally Identifiable Information relating to Users. This non-Personally Identifiable Information is used by Primetag to optimize the performance and yield of the Service, to provide comprehensive reporting to Publishers and Influencers. Non-Personally Identifiable Information is anonymous and cannot generally be used to identify a specific person. For more information regarding cookies, please see Section 2 of this Privacy Policy.

3.6. Your own Privacy Policy

It is the responsibility of the Publisher and Influencer to ensure that its privacy policy, ‘About Us’ or other relevant website section includes the following information, and that the Publisher or Influencer obtains each User’s consent to the privacy policy containing these provisions: a statement regarding use of the Service, for example: “Our website contains some Product tags, which means we get paid per click of those products or services we genuinely write about. However, our editorial content is not influenced by advertisers or partnerships.”, full details about cookies which are dropped by Primetag onto Users’ Computers when Users view a web page or click on a Product Tag from a Publisher or Influencer.

The Publisher or Influencer must also seek the consent of Users before Primetag cookies are dropped. They can decide how to obtain consent but Primetag suggests that Users are requested to consent to the terms of the Publisher and Influencer Privacy Policy. After initial provision of consent by a User, it need not be provided again, unless the purpose of Cookies changed. If Primetag makes relevant changes to its cookies, we will notify you accordingly.

3.7. Security Tips

To help keep your account safe, some things that you can do:
Pick a strong password. It should be different from other passwords you use elsewhere on the internet.
Change your password regularly, especially if you see a message from Primetag asking you to do so.
Never give your password to someone you don't know and trust.
Make sure your email account is secure. Anyone who can read your email can probably also access your Primetag account. Change the passwords for all of your email accounts and make sure that no two are the same.

4. Advertisers

This section describes what information is collected by Primetag from Advertisers and how that information is used by Primetag.

4.1. Information we collect

4.1.1. Registration

When an Advertiser signs up at Primetag to use the Service, we collect and store various pieces of Personally Identifiable Information: name of the Advertiser, Website information, VAT information and Address. Furthermore, we collect the name, profile picture, position, e-mail address and telephone number of the Advertiser representative person.
To join our club they must, in the pre-registration, give their consent before continuing. Only in this way Primetag is sure that the processing of the data is lawful. For this reason it is only possible to proceed if the data subject gives his/her prior consent.

4.1.2. Usage

Whenever you interact with our Services, we may collect personally non-identifiable information using various technologies that cannot presently be used to specifically identify you, such as: IP address, language setting, operating system type, the page you requested, and time stamp. We also collect information about your search and click activity when using the Service in order to optimise the Service for your needs.

4.1.3. Third Party

If you provide or connect your third-party account credentials to an account with a Service, some content and/or information in those accounts may be transmitted into your account with us. For example, when you connect with Lengow Marketplace or TradeDoubler, we may receive Personally Identifiable Information upon your acceptance.
Primetag only accesses this information if you give consent at the due stage.
Note that, user data obtained through social networks will not be transferred to a data broker.

4.2. Use of Information collected

We use the information you provide us upon signing up to perform our obligation under the Agreement: to assess the suitability of the Advertiser for the Service, to contact the Advertiser to help with use and results optimisation, to communicate Primetag-related matters, to provide Advertisers with order and billing history information, to improve the Service we provide to Advertisers based on how they use our Service and the Tools which we provide them, to match and introduce Publishers and Influencers that may wish to enter into agreements with the Advertiser, and to allow the Advertiser to login and access Primetag’s platform.

4.3. Updating Information

Every Advertiser can edit any of their personal information available when using the Advertiser Hub at any time. This information may be added, updated, deleted or changed through time as the Service and the Advertiser Hub changes. It is only the Advertiser's responsability to protect against unauthorised access to their details and the Advertiser Hub, to log-off from the Advertiser Hub when not using it and to keep its password secret.

4.4. How the Information is collected

Once an Advertiser signs up with Primetag to use the Advertiser Hub and the Service, he picks which Tools we wants to work with. These Tools may need integration procedures with our services in order: to collect and store information about the content available in the Advertiser's website, including but not limited to URLs, product names and images, prices, SKUs, order value and order identifier.

4.5. Information collected from users

We will not knowingly collect or store any Personally Identifiable Information pertaining to users visiting an Advertiser's Website. We do use Cookies to collect non-Personally Identifiable Information relating users that have interacted with Primetag through the network of Publishers and Influencers Tools. This non-Personally Identifiable Information is used by Primetag to optimize the performance and yield of the Service, to provide comprehensive reporting to Advertisers, and to provide aggregate reporting to Publishers and Influencers for the purpose of helping them optimize their content. Non-Personally Identifiable Information is anonymous and cannot be used to identify a specific person.

4.6. Your own Privacy Policy

It is the responsibility of the Advertiser to ensure that its privacy policy, ‘About Us’ or other relevant website section includes information about the use of cookies, and that the Advertiser obtains each User’s consent to the privacy policy.

4.7. Security Tips

To help keep your account safe, some things that you can do:
Pick a strong password. It should be different from other passwords you use elsewhere on the internet.
Change your password regularly, especially if you see a message from Primetag asking you to do so.
Never give your password to someone you don't know and trust.
Make sure your email account is secure. Anyone who can read your email can probably also access your Primetag account. Change the passwords for all of your email accounts and make sure that no two are the same.

5. Users

5.1. Primetag

Primetag offers a service both to Publishers or Influencers and Advertisers to help them grow their business online without ever jeopardizing the user's experience online. It stands between both and provides them a platform, the Publisher and Advertiser Hub, and Tools to turn Publisher and Influencer content Shoppable via Product tags.
Every time users click on Product tags they are redirected to the Advertiser's websites. Primetag rewards Publishers and Influencers every time Users click on Product tags and Advertisers pay Primetag to receive qualified visitors from Product tags.
Primetag doesn't sponsor content nor suggest Product tags to both Publishers and Influencers. In another words, Primetag doesn't incentive Publishers nor Influencers to produce content around the available Product tags, but rewards editorial freedom and true influence that is passed on to users.

5.2. Information collected and its use

We don't capture personal data from Users navigating in our Publishers or Influencers network or our Advertisers websites.
We do collect non-Personally Identifiable Information, more precisely: we store a User's random identifier, information about the device that a User uses, such as browser type, browser version, and type of device, and using cookies we do store anonymous information from which Product tags Users click on and whether Users make a purchase at the Advertisers website.
